1) General Provisions
By using SmartSera services—including SmartSera domains, verification pages, promotional pages, and software panels—you agree to these Terms of Use.
If you do not agree, you must not use the services.
This document governs terms of service usage independently of the privacy and cookie policies.
For details on personal data processing, you should be directed to your “Privacy Policy” page.
2) Definitions
- Company: Smart Software Sağlık A.Ş. (owner of the SmartSera brand)
- SmartSera / Service: SmartSera website, dashboards/panels, verification screens, integrations, APIs, reports, and similar digital services
- User: Any individual who visits or uses the services
- Customer: A business/legal entity that uses the services for commercial purposes
- Content: Any information such as text, images, video, data, reports, outputs, and similar materials
- Account: A user profile/session that provides access to the panel
3) Scope and Nature of the Service
SmartSera may provide software components that support the digital management of greenhouse operations, traceability and reporting interfaces,
verification pages, and similar modules. The scope of the service may vary depending on the package, license, agreement, technical requirements,
and customer needs.
Important: SmartSera is a decision-support tool. Agricultural practices, chemical usage instructions,
regulatory compliance, and operational decisions remain the sole responsibility of the Customer/User.
4) Acceptable Use and Prohibited Conduct
You must not use the services for any of the following:
- Illegal activities, rights violations, fraud, or abuse
- Damaging the system, reverse engineering, or attempting to extract source code
- Unauthorized access attempts, vulnerability scanning, or attacks (including DDoS)
- Using another person’s account or taking over an account
- Automation or excessive load that disrupts service operation (exceeding rate limits)
- Misrepresentation/false statements, fake content, or fake identity usage
In the event of any of the above violations, the Company may take necessary measures including suspending services, restricting access,
suspending accounts, or terminating access.
5) Account, Authorization, and Security
For services that provide panel access, authentication methods such as usernames, passwords, tokens, or similar may be used.
The User is responsible for account security and for not sharing credentials with third parties.
- Do not share your password/session information with anyone.
- If you notice suspicious activity, report it to info@smartsera.tr.
- The Company may end sessions or require additional verification to ensure security.
6) Data, Content, and Use of Records
Data entered into the system by the User or Customer (e.g., operation logs, reports, barcode/QR verification data,
production/batch/shipment information, sensor measurements) is processed for the purpose of providing the service.
Data processing and retention practices are subject to the applicable “Privacy Policy” and, where relevant, contractual terms.
6.1) Accuracy Responsibility
The accuracy and currency of data entered into the system are the responsibility of the Customer/User.
The Company cannot be held responsible for incorrect reports or outputs resulting from inaccurate/incomplete data.
6.2) Backup and Retention
The Company aims to apply reasonable security measures; however, uninterrupted service cannot be guaranteed due to the nature of the internet and IT systems.
For critical records, the Customer is advised to maintain additional internal backup/contingency procedures.
7) Intellectual Property Rights
The SmartSera software, design, brand, logo, interface, texts, and all components belong to the Company or are used under license.
They may not be copied, reproduced, sold, distributed, or used to create derivative works without prior written permission.
The Customer retains rights to its own data and content uploaded by the Customer. However, the necessary usage permission
for processing such content to provide the service is granted by the nature of the service.
8) Pricing, Packages, and Contractual Terms
Some SmartSera services may be available for free as promotional/demo features, while certain modules may be offered under paid licenses/packages.
Fees, scope, usage limits, term, and cancellation/renewal rules are applied according to the quotation, agreement, or rules stated in the panel.
- For paid services, invoicing/payment processes are conducted in accordance with applicable laws.
- Package limits (number of users, number of devices, data retention period, etc.) may be defined separately.
- Refund/cancellation policy is specified in the agreement or quotation.
9) Third-Party Services and Integrations
SmartSera may use third-party services such as maps, notifications (e-mail/messaging), weather data, video hosting, or similar.
The Company may not be responsible for delays caused by interruptions, API changes, or terms of these services.
Third-party services are subject to their own terms of use.
10) Limitation of Liability
The Company aims to provide the service with reasonable care. However, you acknowledge that the services are provided “as is”
and that uninterrupted or error-free operation is not guaranteed.
- The Company is not liable for indirect damages such as loss of profit, business interruption, or data loss.
- Agricultural practices, chemical usage, regulatory compliance, and the outcomes of operational decisions are the responsibility of the Customer/User.
- The Company’s total liability may be limited to the fees paid for the relevant period (if an agreement exists, the agreement prevails).

11) Suspension and Termination
The service may be temporarily suspended or terminated in the following cases:
- Violation of these Terms of Use
- Security risk or suspected misuse
- Legal obligations or official authority requests
- Payment delays / license expiration (for paid services)
- Maintenance/infrastructure updates (with prior notice where possible)
12) Changes
The Company may update these Terms of Use. The updated text becomes effective upon publication on the website.
In the case of material changes, reasonable notice may be provided.
13) Governing Law and Jurisdiction
This document is governed by the laws of the Republic of Türkiye. To the extent permitted by mandatory law, the courts and enforcement offices of
Afyonkarahisar shall have jurisdiction for disputes.
For international users: Subject to mandatory local consumer protection rules, this clause applies unless the parties agree otherwise in writing.
